Quando a socioafetividade não basta...

Resumo

Este trabalho tem por objetivo convidar a comunidade jurídica a refletir sobre a necessidade de se redimensionar a importância que vem sendo dada à paternidade socioafetiva, como fator legitimante da manutenção do registro civil constituído por erro essencial, nas hipóteses em que a posterior descoberta da verdade sobre a paternidade biológica implicar no total rompimento do vínculo afetivo eventualmente construído entre pai e filho, podendo gerar riscos à criança. Defende que a adoção de tal proceder em casos específicos possa acarretar uma melhor observância aos primados da paternidade responsável e do superior interesse da criança, contrariamente ao que aconteceria se o registro de nascimento fosse mantido intocado ou se apenas se restringisse o alcance do poder familiar. Após uma inicial abordagem sobre a importância do afeto nas relações familiares, o estudo prossegue traçando breves linhas sobre as modalidades de paternidade socioafetiva, até ingressar no âmago do assunto, no qual será enfrentada a problemática e proposta uma tentativa de sistematização da matéria, à luz do ordenamento jurídico brasileiro.

ABSTRACT: This paper’s goal is inviting the legal community to consider the matter on the need to reevaluate the relevance of the socioaffective fatherhood as a legitimate factor of maintaining the paternity establishment based of fraud, in those cases that the genetic tests demonstrate that the established father is not the biological father of the child, causing a total disruption of affection and certain risks to the child onwards. Argues that adopting such a course in specific cases can lead to better compliance the principles of responsible parenthood and the children’s best interests, in opposition to what would happen if the birth certificate is not modified or some of the parental rights and duties toward his child are restricted. After an initial approach to the importance of affection in family relationships, the study continues by drawing short lines on the modalities of socioaffective fatherhood, to enter the heart of the matter, which will be facing the problem and offered an attempt to systematize the matter in the Brazilian legal system.
