JUSTICE AND DECISION: LINKING THE JUDICIARY TO VALUES OF JUSTICE

RESUMO: O presente artigo terá por objetivo percorrer a busca de juridicidade de uma decisão justa, sustentando uma absorção valorativa necessária por parte do aplicador do direito positivo decorrente da abertura sistêmica da Constituição. Visualiza-se a Constituição como um sistema aberto de princípios e regras, configurando um todo complexo formado por redes de relações de elementos normativos distintos. Quando falamos que a Constituição é um sistema aberto, pressupomos que há uma interação constante entre o meio ambiente social e o sistema constitucional. O sistema constitucional está em infinito intercâmbio com o seu meio ambiente para trocar energia e informação. Ele absorve as informações e energias recebidas do ambiente e exporta um resultado que visa a responder as expectativas sociais. Essa abertura sistêmica é manifestada pela alta carga axiológica decorrente dos princípios e dos conceitos jurídicos indeterminados. Ao Judiciário foi atribuída a função de in concreto aplicar o Direito e solucionar os conflitos de interesses. Sendo o Direito um sistema aberto a valores, e estando o Estado vinculado ao Direito, deve o Judiciário proferir decisões judiciais “justas”, consonantes aos ditames de justiça vigentes no meio ambiente social.

ABSTRACT: The present article will have for objective to cover the search of legality of a decision “right”, working with a necessary absorption of values for the applicator of the Positive law based in the fact that the Constitution is an open system. The Constitution is an open system of principles and rules, configuring one all complex formed by nets of relations of distinct normative elements. When we speak that the Constitution is an open system estimates that has a constant interaction between the social environment and the constitutional system. The constitutional system is in infinite interchange with its environment to change energy and information. It absorbs the information and energies received from the environment and exports a result that needs to answer the social expectations. This opening is revealed by the high load of values decurrent of the principles and the indeterminate legal concepts. To the Judiciary was attributed the function of in to apply the Right and to solve the conflicts of interests. Being the Law an open system of values, and being the State tied in to the Law, must the Judiciary pronounce sentences “jousts”, that obey the effective justice vision in the social environment.
