Resumo

FACING THE FUTURE: SUBSTANTIVE EQUALITY UNDER THE SPOTLIGHT

RESUMO: A igualdade substantiva nasce da decepção e frustração com os limites da igualdade formal. No entanto, o conteúdo específico da igualdade material permanece controvertido. Argumenta-se, aqui, que a igualdade substantiva tem quatro diferentes dimensões: em primeiro lugar, a quebra do ciclo de desvantagens associadas com status ou a grupos; em segundo lugar, a promoção do respeito pela igual dignidade e valor de todos; em terceiro lugar, a acomodação e afirmação positiva das diferentes identidades; e, finalmente, a correção de uma sub-representação na tomada de decisões. Esse entendimento tetradimensional da igualdade substantiva não prescinde da análise de como as dimensões se relacionam entre si. Nesse contexto, a ação afirmativa constitui uma síntese valiosa entre status e desvantagem, especificamente ao anexar benefícios socioeconômicos aos desfavorecidos por status. Quanto ao controle judicial, o papel do juiz deve ser promover a igualdade substantiva, e, portanto, apoiar medidas governamentais que visam a atingir a igualdade substantiva. No entanto, tal apoio não deve ser confundido com deferência às decisões governamentais. É importante reconhecer as limitações da ação afirmativa como uma estratégia e enxergá-la apenas como uma parte de um plano de base ampla e radical, que faz mais do que redistribuir posições privilegiadas, mas refaz as instituições que continuam a perpetuar a exclusão.

ABSTRACT: The substantive equality is born of disappointment and frustration with the limits of formal equality. However, the specific content of substantive equality remains controversial. It is argued here that substantive equality has four different dimensions: first, breaking the cycle of disadvantage associated with groups or status, and secondly, to promote respect for the equal dignity and worth of all, in the third place, the accommodation and positive affirmation of different identities, and finally, the correction of an under-representation in decision-making. This four-dimensional understanding of substantive equality does not obviate the analysis of how the dimensions relate to each other. In this context, affirmative action is a valuable synthesis between status and disadvantage, particularly when attaching benefits socioeconomic for the disadvantaged status. As for judicial review, the judge’s role should be to promote substantive equality, and therefore support government measures aimed at achieving substantive equality. However, such support should not be confused with deference to government decisions. It is important to recognize the limitations of affirmative action as a strategy and see it only as a part of a broad-based radical, which does more than redistribute privileged positions, but remaking the institutions that continue to perpetuate the exclusion.
