O “estilo” jurídico alemão – Breves considerações sobre alguns dos seus fatores determinantes

Resumo

O presente trabalho procura identificar as principais características do “estilo” jurídico alemão, quase todas ligadas ao seu passado histórico. Mostra a enorme influência do Direito romano no Direito alemão, especialmente por ocasião da sua recepção na parte final da Idade Média, bem como em razão do aprofundamento dogmático realizado pela Escola das Pandectas, ao longo do século XIX. Mostra a importância da doutrina (Professorenrecht) na formação e no desenvolvimento do Direito alemão, expõe a típica forma mentis do seu jurista e sua formação acadêmica. Detém-se, também sobre a estruturação do poder na Alemanha moderna, sua organização judiciária e as fontes do Direito alemão, com especial destaque para seu Código Civil e para sua Constituição.

ABSTRACT: This paper attempts to identify the main features of the German legal “style”, most linked to its historical past. It shows the great influence of Roman law in German law, especially through his reception at the end of the middle ages, as well as through the contributions of the dogmatic School of the Pandects, in the 19th century. It indicates the importance of the doctrine (Professorenrecht) in the formation and development of German law, it exposes the typical forma mentis of his lawyer and his academic formation. It also describes the division of powers in modern Germany, its judicial organization and the sources of German law, with special emphasis on its Civil Code and its Constitution.
