Uma ponte entre Zaffaroni, Ferrajoli e Ost – A construção do modelo de juiz democrático contemporâneo (e constitucional) na sociedade hipercomplexa

Resumo

O presente estudo apresenta pesquisa sobre a evolução da magistratura e sua classificação em conformidade, basicamente, a três teorias de autores mundialmente renomados. O jurista argentino Eugenio Raúl Zaffaroni desenvolveu um estudo que mostra uma linha evolutivo-cronológico da magistratura tendo em consideração dois aspectos fundamentais: a forma de acesso aos cargos do judiciário e a existência de um controle por órgão externo e democrático. O jusfilósofo italiano Luigi Ferrajoli, por seu turno, não acrescentou nenhuma alteração nessa evolução, mas apresentou estudos que indicam um modelo de juiz democrático e constitucional para a sociedade atual. Já, François Ost, jurista belga, apresentou modelos evolutivos de Magistrados que têm em conta a evolução da sociedade, do direito e da magistratura, em paralelo com as mudanças da sociedade.

ABSTRACT: This paper presents a research on the evolution of the judiciary and its classification in accordance to basically three theories of world-renowned authors. The Argentine jurist Eugenio Raúl Zaffaroni developed a study that shows an evolutionary-chronological line of the judiciary taking into account two main aspects: the form of access to the positions of the judiciary and the existence of a control by external and democratic body. The Italian jurist and philosopher, Luigi Ferrajoli, in turn did not add any change in that evolution, but presented studies suggesting a model of democratic and constitutional judge for today's society. Yet, François Ost, Belgian jurist, presented evolutionary models of magistrates that take into consideration the evolution of society, law and judiciary, in parallel with changes in society.
