As contribuições das ações coletivas no cenário dos conflitos massificados: uma defesa da tutela jurisdicional coletiva

Resumo

O presente artigo tem por objetivo traçar as principais contribuições das ações coletivas para resolução dos conflitos de massa, assim considerados aqueles que envolvam os direitos transindividuais, especialmente os direitos individuais homogêneos, que assoberbam o Poder Judiciário na atualidade. Defende-se, assim, que nos conflitos massificados a tutela jurisdicional coletiva: a) propicia um efetivo e justo acesso à justiça; b) implica economia e eficiência processual; c) ostenta um valor pedagógico; d) acarreta isonomia no julgamento e segurança jurídica; e) concretiza o direito material.

ABSTRACT: The present article aims to show the main contributions of class actions for the resolution of collective actions considering those which involve trans individual rights, specially the individual homogeneous rights, thus overwhelming the Judiciary nowadays. Therefore, it is argued that in mass conflicts the jurisdictional collective custody: a) provides fair and effective access to justice; b) infers economy and efficiency in the process; c) has pedagogical value; d) results in equality in judgment and legal security; e) implements the material right.
