Resumo

CONSTITUTIONALISM AND THE CONSTITUTIONAL STATE

RESUMO: O presente trabalho possui como objetivo analisar o papel do Estado Constitucional no século XXI, entendendo o Estado como Estado Constitucional aberto e cooperativo erigido nas democracias pluralistas, resultado da síntese de um conjunto de transformações ocorridas nas democracias pluralistas nas últimas décadas, especialmente após as duas grandes guerras do século passado. Entende-se que o Estado Constitucional e o Constitucionalismo do século XXI efetivamente superam, ao menos em parte, os núcleos conceituais dos padrões do Estado liberal juspositivista, principalmente quanto à realização substantiva de direitos, bem como nas relações internas entre os domínios do político e do jurídico, assim como a necessária transferência de fragmentos de soberania a centros de decisão não estatais ou supranacionais, como condição para satisfazer a demanda de acordos políticos adequados para a nova realidade de vínculos e interdependências.

ABSTRACT: The present work aims to analyze the role of the Constitutional State in the 21st century, understanding the State as an open and cooperative Constitutional State erected in pluralistic democracies, result of the synthesis of a set of transformations that have occurred in pluralistic democracies in recent decades, especially after the two great wars of the last century. It is understood that the Constitutional State and constitutionalism of the 21st century effectively surpass, at least in part, the conceptual core of the standards of the juspositivist liberal state, mainly regarding the substantive realization of constitutional rights, as well as in the internal relations between the political and legal domains, as well as the necessary transfer of fragments of sovereignty to non-state or supranational decision-making centers, as a condition to satisfy the dismantling of appropriate political agreements for the new reality of bonds and interdependencies.
