LIBERDADE DE INFORMAÇÃO E SEGURANÇA PÚBLICA: A PROBLEMÁTICA PONDERAÇÃO CONSTITUCIONAL NA LUTA CONTRA O TERRORISMO INTERNACIONAL

FREEDOM OF INFORMATION AND PUBLIC SAFETY: A COMPLICATED CONSTITUTIONAL BALANCE IN INTERNATIONAL TERRORISM BATTLE

RESUMO: O presente artigo possui como problema geral o estudo de duas posições constitucionais que podem, eventualmente, colocar-se em conflito: de um lado, a liberdade individual relacionada ao acesso e à transmissão de informação, uma liberdade essencial para a estrutura do Estado Democrático de Direito; de outro, a busca cada vez mais árdua pela segurança pública, principalmente no que diz respeito aos atos de terrorismo internacional. Sendo assim, considerando que nenhum direito fundamental reveste-se de caráter absoluto, o objetivo deste trabalho é encontrar um ponto de equilíbrio no âmbito da Constituição italiana e das Convenções europeias sobre a temática, buscando garantir os direitos em questão com sua máxima efetividade. Definiu-se como metodologia analisar as mais recentes diretivas da União Europeia sobre o assunto, bem como a jurisprudência do Tribunal Constitucional Italiano e da Corte Europeia de Direitos Humanos. 

ABSTRACT: The present paper has as its main problem the study of two constitutional positions that may, eventually, be at odds, at one side the individual freedom related to access and transmission of information, an essencial liberty in the Democratic rule of law structure and, on the other, the ever tougher goal of public safety, specially concerning acts of international terrorism. This way, taking into consideration that no rights have are absolute, the aim of this work is finding a balancing point among Italian Constitutional Law and Conventional European Law regarding the subject, looking for a way to safeguard the rights in question with their maximum effectivity. As for the metodology strived for analysing the most recent European Union directives on the subject, as well as the Italian Supreme Court jurisprudence and European Human Rights Court.
