Resumo

DIGNITY AND PRISION AT EUROPEAN CONSTITUTIONAL EXPERIENCE

RESUMO: O presente artigo trata da efetividade do sistema penal em um Estado Democrático de Direito, ou seja, a tutela do preso em um sistema fundado no constitucionalismo democrático e na dignidade da pessoa humana, tendo a experiência europeia como modelo de estudo. Nesse sentido, questiona-se qual o sentido da manutenção do encarceramento como forma predominante de punição, tendo em vista sua baixa efetividade quanto à possibilidade de ressocialização. Percebe-se, desta forma, a necessidade de se reafirmar o sistema penal como um meio de garantia da dignidade, por meio da manutenção de garantias processuais e materiais capazes de conceber um sistema humanizado, visando à manutenção da paz social, e não à mera retribuição. 

ABSTRACT: The following article concerns the effectivity of the penal system in a democratic rule of law, meaning, the guardianship of arrested people in a system based on democratic constitutionalism and human dignity, having the european experience as a model for this study. It is questioned what is the reason for keeping mass encarceration as the main form of punition, seeing that it has low effectivity regarding its possibility of ressocialization. Thus, it can be noted that it is necessary to reaffirm the penal system as a means to guarantee human dignity, through maintenance of procedural and material rights capable of conceiving an humanized system, aiming for social peace and not mere retribution.
