COMMENTS OF THE SUPREMO TRIBUNAL FEDERAL JURISPRUDENCE: ADPF 187 E ADI 4274

RESUMO: O presente estudo acerca das ações ADPF 187 e ADI 4274 referentes à “marcha da maconha” objetiva analisar a importância do julgamento do Supremo Tribunal Federal, uma vez que o julgamento de tais ações envolve a discussão dos direitos fundamentais da liberdade de expressão e da liberdade de reunião. Desse modo, a pesquisa aborda, em um primeiro momento, as razões da proposição das ações ADPF 187 e ADI 4274. Em um segundo momento, mostram-se os votos dos Ministros Relatores e a posição do Supremo Tribunal Federal. Em um terceiro momento, evidenciam-se os aspectos constitucionais da ADPF 187 e da ADI 4274. No quarto capítulo, apresenta-se o impacto do julgamento na sociedade brasileira. Conclui-se a pesquisa enaltecendo a decisão do Supremo Tribunal Federal, bem como os cuidados que se deve ter com o desdobramento equivocado da decisão.

ABSTRACT: This study of the actions called ADPF 187 and ADI 4274 regarding “marijuana march” aims to analyze the importance of the trial of the Supremo Tribunal Federal, since the trial of such actions involves the discussion of fundamental rights of freedom of expression and freedom of assembly. Thus, the research focuses in the first instance of the reasons for proposing actions called ADPF 187 and ADI 4274. In a second moment, it is the votes of the Ministers Rapporteurs and the position of Supreme Court. In the third stage, it is clear the constitutional aspects of the ADPF 187 and ADI 4274. In the fourth chapter, it is presented the impact of the trial in Brazilian society. We conclude the research extolling the decision of the Supreme Court, as well as the care that must be wrong with the split decision.
