Judiciário interventivo, acesso à justiça e a judicialização das relações sociais

Resumo

O artigo se destina ao estudo da judicialização das relações sociais como resultado da ampliação do acesso à justiça para efetivação dos direitos constitucionalmente garantidos. O objetivo geral da pesquisa é identificar a função dos Tribunais na atualidade no que se refere à judicialização das relações sociais e à constante institucionalização das relações privadas. As hipóteses construídas pelas teorias procedimentalistas e substancialistas apontam para a necessidade de delimitação e contenção do processo de intervenção do Poder Judiciário nas relações sociais. O fundamento teórico é baseado nas obras de Jürgen Habermas e Mauro Cappelletti. O método utilizado será o indutivo por meio da utilização de categorias jurídicas e pesquisa bibliográfica.

ABSTRACT: The article is intended to study the judicialization of social relations as a result of increased access to justice for realization of constitutionally guaranteed rights. The overall objective of the research is to identify the function of the courts at present regarding the legalization of social relations and the constant institutionalization of private relations. The hypotheses constructed by proceduralists and substantialists theories point to the need for demarcation and containment of intervention of the Judiciary in social relations process. The theoretical foundation is based on the works of Jürgen Habermas and Mauro Cappelletti. The method used is by using the inductive legal categories and literature.
