Ética na pesquisa científica: plágio involuntário e direito autoral

Resumo

O artigo enfrenta as preocupações com a ética do trabalho científico, em especial no que diz respeito ao reconhecimento da autoria, e questiona a possibilidade da figura do “plágio involuntário” dentro de um contexto ético e jurídico. O artigo aborda o significado histórico do plágio, se o conceito se mantém historicamente ou se, na atualidade, o conceito deve ser revisto, considerando as formas inegáveis de diluição do significado também de autoria, questão que merece também adequado enfrentamento, em especial diante do panorama de proteção constitucional conferida ao direito de autor, como direito fundamental.

ABSTRACT: The article focuses on the concerns about the ethics of scientific and academic intellectual work, especially with regard to recognition of authorship, and questions the possibility of the figure of “unintentional plagiarism”, within an ethical and legal context. In addition, the article discusses the historical meaning of plagiarism itself, if the concept remains historically unchanged until the present, or not, considered the undeniable forms of dilution of meaning of authorship, question which also deserves adequate confrontation, particularly given the landscape of constitutional protection afforded to copyright as a fundamental right.
