Expectativas e propostas acerca do inquérito policial

Resumo

Uma das crises importantes do sistema de justiça criminal situa-se na fase preliminar ao processo penal, mais precisamente no inquérito policial. A problemática perpassa os sujeitos, os atos investigatórios, as atividades, a sua funcionalidade e a preservação dos direitos fundamentais. As deficiências e misérias da investigação criminal no sistema brasileiro foram reconhecidas pela Comissão e Corte Interamericanas de Direitos Humanos, em vários casos: Maria da Penha (1983), Damião Ximenes Lopes (2006), Garibaldi (2009), Escher e outros (2009). Circunscreve, a exposição, a funcionalidade do inquérito policial, à base fática à acusação criminal, propondo várias formas de reconstrução do inquérito policial, com a superação de metodologias arcaicas, uma filtragem para evitar a contaminação judicial e a construção de uma teoria geral do Direito Policial.

ABSTRACT: One of the important crises of the criminal justice system is located at the preliminary stage of criminal proceedings, specifically in the police investigation. The problem pervades the subject, investigative acts, activities, their functionality and preservation of fundamental rights. The weaknesses and miseries of criminal investigation in the Brazilian system were recognized by the Inter-American Commission and Court of Human Rights in several cases: Maria da Penha (1983), Ximenes Lopes (2006), Garibaldi (2009), Escher et alli (2009). Limited, the exposure, the functionality of the police investigation, the factual basis of the criminal charge, proposing various forms of reconstruction of the police investigation and the overcoming of archaic methodologies, filtering to prevent contamination and judicial construction of a general theory of the Police Law.
