Estado, Democracia e Poder Judiciário nos cien años de soledad de Gabriel García Marquez

Resumo

O artigo faz uma interlocução entre o Direito e a Literatura, para compreender como os temas jurídicos e estatais, especialmente as eleições democráticas e o Poder Judiciário, são retratados na obra Cien años de soledad (“Cem anos de solidão”), de Gabriel García Marquez. O pressuposto é que a arte, e em especial a Literatura, permite ao jurista acesso a uma visão externa do funcionamento da prática judicial, a qual ele próprio não pode produzir por estar existencialmente envolvido com o Direito. O artigo mostra como o livro trata o Estado e o Judiciário com desconfiança, entendendo as instituições jurídicas e políticas como instrumentos de corrupção e criminalidade oficial, especialmente quando narra a eleição fraudada, disputada entre conservadores e liberais, e quando expõe a atividade dos advogados e as decisões judiciais como instrumentos capazes de criar novas verdades, distorcendo ou apagando a realidade para atender aos interesses do poder econômico.

ABSTRACT: This article is a dialogue between law and literature. It aims to understand how the legal and State issues, especially democratic elections and the Judiciary, are portrayed in the book Cien años de soledad (“One Hundred Years of Solitude”) by Gabriel Garcia Marquez. The assumption is that art, especially literature, allows to a lawyer access to an outside view of the functioning of judicial practice, which lawyers themselves are not able to produce to be existentially involved with the law. The article shows how the book deals with the State and the Judiciary with suspicion, understanding the legal and political institutions as instruments of corruption and official crime, especially when narrating the rigged election, disputed between conservatives and liberals, and when exposes lawyers and judicial decisions as able to create new truths, distorting or erasing reality to serve the interests of economic power.
