Aspectos médicos, bioéticos e jurídicos do uso de material genético na reprodução humana assistida “post mortem” a partir de um estudo casuístico

Resumo

O problema ético e legal relativo à utilização da técnica de reprodução humana assistida (RHA) no Brasil diz respeito ao uso e à manipulação do material genético criopreservado. Esta questão recebeu maior destaque principalmente após a decisão judicial que viabilizou a RHA com uso de material genético, coletado previamente e manipulado de forma post mortem. Este caso judicial possui fatos e circunstâncias que exigem uma contínua reflexão sobre os aspectos éticos e legais envolvidos. Desta forma, por meio do método qualitativo casuístico, elegeu-se o caso judicial para estudo, tendo o presente artigo o objetivo de abordar os aspectos médicos, bioéticos e jurídicos da utilização do material genético em um procedimento de reprodução humana assistida post mortem, adotando como referencial teórico a bioética complexa.

ABSTRACT: The ethical and legal issues concerning the use of the technique of assisted human reproduction (AHR) in Brazil with respect to the use and manipulation of genetic material cryopreserved. This issue has received greater prominence especially after the court ruling that allowed the RHA with the use of genetic material, previously collected and manipulated post mortem. This court case has facts and circumstances that require continuous reflection on the ethical and legal aspects involved. Thus, through the casuistry qualitative method, was elected this case for study, having this article the objective of addressing the medical, bioethical and legal aspects of the use of genetic material in a procedure of assisted human reproduction post mortem, using the framework of complex bioethics.
