Abstract

ENVIRONMENT AND SUSTAINABLE DEVELOPMENT – CIVIL LIABILITY FOR DAMAGE TO THE ENVIRONMENT

RESUMO: O presente trabalho tem por objetivo examinar o desenvolvimento dado pelo Direito francês à responsabilidade civil por danos ao meio ambiente. Examina, em primeiro lugar, as particularidades relativas à noção de dano. Em segundo lugar, trata das principais questões decorrentes dessa disciplina, tais como a solução dada aos danos morais para as pessoas jurídicas, bem como os legitimados para a tutela do meio ambiente no campo da responsabilidade civil no direito civil francês.

ABSTRACT: The present work aims to examine the development given by French law to civil liability for damage to the environment. Firstly, it examines the particularities relating to the notion of damage. Secondly, it deals with the main issues arising from this discipline, such as the solution given to moral damages for legal entities, as well as those legitimized for the protection of the environment in the field of civil liability in French civil law.
