Theory of Fundamental Duties
Tribute to the 100th anniversary of the Association of Professors of German Constitutional Law and 40th anniversary of the notebook dedicated to Fundamental Duties
Abstract
The study honors the centenary theoretical contribution of the Association of Professors of German Constitutional Law to Brazilian legal science, with emphasis on the meeting that dealt exclusively with the theory of fundamental duties forty years ago, in order to contribute to overcoming confusion, resistance and prejudice for its theoretical-dogmatic development under the Brazilian constitutional perspective. The discussions dealt with at that meeting resonate to this day in the specialized literature, as an open topic and always updatable in the face of new challenges and new dimensions of fundamental rights, such as the projections of fundamental ecological duties to future generations. In this context, the main reasons for the theoretical atrophy of fundamental duties are presented, followed by the main criticisms and objections to their autonomous theoretical relevance, for the enriched treatment, beyond the exclusive grammar of fundamental rights, of permanent and new questions to contemporary constitutionalism, with emphasis on the theoretical-dogmatic distinction between fundamental duties and limits to fundamental rights.
