A noção de justiça nas teses relativistas dos direitos humanos

Resumo

O presente estudo tem por objetivo discutir as insuficiências teóricas da noção de Justiça nas teorias relativistas dos direitos humanos, por meio da análise de suas bases epistemológicas, bem como as influências que têm exercido sobre as legislações internacional e nacional. Para tanto, analisam-se as três principais correntes relativistas atualmente defendidas: as antropológicas, as epistemológicas e as culturais, expondo-se os seus argumentos e as consequências que a sua aplicação acarreta no cenário político e social dos países que as adotam. Ao final, apontam-se os problemas e as insuficiências teóricas que as três teorias relativistas apresentam, ressaltando-se os danos práticos e históricos que têm produzido.

ABSTRACT: This study aims to discuss the shortcomings of the concept of justice in Relativistic Theories of Human Rights, through the analysis of its epistemological foundations, as well as the influences they have had on the international and national legislation. For this, it analyzes the three main relativistic currents presently held: the anthropological, the epistemological, and the cultural, exposing their arguments and the consequences that its application entails in the political and social landscape of the countries that adopt them. At the end, it shows the problems and shortcomings that the three theoretical relativistic theories present, emphasizing the practical and historical damage that they have produced.
