Conflito, Poder Judiciário e os equivalentes jurisdicionais: mediação e conciliação

Resumo

Este estudo tem como cerne apresentar os mecanismos alternativos/consensuais de solução de conflitos, como equivalentes jurisdicionais e funcionais, que aparecem com o intuito de efetivar o acesso à justiça e oferecer aos conflitos diversos caminhos para a solução adequada. Para tanto, analisam-se as diferenças entres esses mecanismos, a sua aproximação ao tradicional Poder Judiciário brasileiro e os desafios para a adequada implementação dos equivalentes jurisdicionais durante o processo judicial. Para subsidiar este estudo, foram realizados levantamento bibliográfico e análise de documentos. O estudo revelou que esse movimento de aproximação entre os equivalentes jurisdicionais, em especial a mediação, a conciliação e o Poder Judiciário, vem acontecendo no Brasil, sendo importante e fundamental a compreensão das diferenças entre eles para garantir o respeito à essência desses mecanismos e a sua adequada implementação.

ABSTRACT: The study aims to present alternative/consensual mechanisms of conflict resolution, such as mediation and conciliation as jurisdictional and functional equivalents. It shows the possibility of effective access to justice and offer various ways to solve conflitcts. For this purpose, this paper analyzes the differences between these mechanisms, their approach to the traditional Brazilian Judiciary and the challenges for its adequate implementation during the court proceedings. To support this study was conducted literature review and analysis of documents. The study revealed that there are movements and actions towards gathering these mechanisms, particularly mediation and conciliation and the Judicial System in Brazil and that is necessary and fundamental the correct understanding of differences between them, its concepts, objectives and methods to ensure compliance with the essence of these mechanisms and their proper implementation.
