Motivação das decisões judiciais e argumentação jurídica como fatores legitimantes da prestação jurisdicional

Resumo

Objetiva o presente estudo discorrer a respeito da motivação das decisões judiciais, bem como da argumentação jurídica que deve ser desenvolvida pelo magistrado ao elaborar os seus provimentos. De fato, o juiz não se encontra adstrito somente à previsão legal, devendo pautar-se pelo conjunto probatório e pelas manifestações das partes, bem assim pela realidade social na qual está inserido o caso sub judice. Dessa forma, deve o magistrado utilizar-se de técnica argumentativa capaz de persuadir os receptores do provimento judicial de que o seu entendimento é o correto para o caso, assegurando, destarte, a segurança e a legitimidade da prestação jurisdicional.

ABSTRACT: This study aims to discuss about the motivation of judicial decisions, as well as the legal arguments that must be developed by the magistrate when preparing its provisionses. In fact, the judge is not attached only to legal provision, should be guided by the evidence together, and the manifestations of the parties as well as the social reality in which the present case is inserted. Thus, the magistrate must make use of argumentative technique capable of persuading the court upheld the receivers that your understanding is correct for the case, ensuring thus, the safety and legitimacy of adjudication.
